A forensic pathologist disputes a New York City medical examiner’s determination that former Marine Daniel Penny killed another man by placing him in a chokehold on a subway train last year.

Jordan Neely died from the “combined effects” of a number of a factors, not a chokehold, a forensic pathologist hired by Daniel Penny’s attorneys testified Thursday.

The defense has rested its case in the trial of Daniel Penny, the former Marine who held Jordan Neely in a fatal chokehold on the New York City subway last year, after four days of witness testimony.

The testimony came as defense lawyers to put the homeless man's mental health history at the center of the second-degree manslaughter and criminally negligent homicide case against Daniel Penny, a West Islip native.

A psychiatric expert testifying in Daniel Penny’s defense said Jordan Neely had one of the most severe histories of paranoid schizophrenia he has ever reviewed.

The witness, who aided Penny during the incident, said he lied afterward about Neely being alive since he was scared of “getting pinned for a murder charge.”
